New York Asbestos Lawsuits
Asbestos is a dangerous fiber that can cause various serious medical conditions, such as mesothelioma. A New York
asbestos lawyer is skilled in handling asbestos lawsuits that seek compensation for victims and their families who have been exposed to this harmful substance. These cases can be complicated and it is crucial to have a mesothelioma expert law firm by your side.
New York has a long history of asbestos litigation and many residents have been exposed to this dangerous substance. In recent years, there have been more lawsuits against former asbestos producers than ever before. These cases stem from the recognition of a connection between asbestos and diseases like mesothelioma, lung cancer, and asbestosis. These companies were aware of the dangers that asbestos posed however, they failed to inform the employees and the public.
New York City is especially susceptible to illnesses caused by
asbestos case due to its old structures and many construction sites. Brooklyn Navy Yard is a notoriously hazardous area that continues to impact the surrounding community.
Many workers were exposed to asbestos in the workplace. However, people also get diagnosed with mesothelioma following exposure to harmful substances. This includes spouses of asbestos-exposure workers who wore their husband's work clothes and came in contact with asbestos dust regularly.
The mesothelioma lawsuit can be costly for defendants. This is particularly true if they have been wrongly identified as defendants. A study shows that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could grow. The asbestos law firms that specialize in
asbestos often advertise on television during the day and encourage victims to file claims with the promise that they will receive substantial settlements.
The defendants could be able to reduce the cost of these cases by arguing their policy periods are expired or that they are only responsible for only for a small proportion of the value of the claim. New York law does not provide a definitive rule on how to allocate responsibility when the alleged exposure is within and part outside of the insurance policies.
Asbestos-related illnesses
Exposure to asbestos can trigger many different illnesses. The mesothelioma disease is the most severe. Many people have died due to mesothelioma. Other asbestos-related illnesses include lung cancer and asbestosis. Pleural plaques and pleural effusion are also asbestos-related.
Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos fibers which accumulate in the lungs and cause irritation to the lining of the ribcage, chest cavity and abdominal cavity (the pleura). Inhaling these fibers can lead to scarring in the lungs, known as asbestosis. It can also lead to thickened patches of pleura (pleural plaques) or a more extensive fibrosis. Pleural plaques and diffused fibrosis reduce lung capacity as determined by breathing tests. They also cause discomfort and breathing difficulties but they don't cause mesothelioma or cancer.
Most of the time, symptoms of asbestos-related diseases do not appear until decades after the initial exposure. It can take as long as 50 years for asbestos-related fibers to be inhaled to cause lung damage. People who are at risk of developing mesothelioma or other asbestos-related conditions include workers who handled, cleaned and removed asbestos-containing products from their workplaces and spouses and children of those exposed to asbestos.
Other asbestos-related diseases in addition to mesothelioma, include lung cancer and laryngeal carcinoma, peritoneal, ovarian, and peritoneal cancer. The most deadly mesothelioma type is ovarian cancer, but it's less prevalent than mesothelioma in general. It is usually diagnosed later than other kinds of mesothelioma because it is a cancer that develops in the tissues of the reproductive organs, and the symptoms may be similar to symptoms of other diseases.
Several companies used asbestos during the 20th century. They were aware that it was a risk. They exposed thousands of people to asbestos because they failed to remove it from their products. These people can now claim financial compensation. Many asbestos-related companies are insolvent. As a result, the victims can seek the money they deserve from the trust funds set up by the bankruptcy courts.

New York is one such state with its own asbestos court, known as NYCAL. The caseload in this specialty court has increased steadily, as
asbestos case victims are becoming more and more likely to seek compensation from solvent former asbestos defendants who went bankrupt. The New York Supreme Court created a special judicial board to oversee NYCAL in order to prevent the justice system from becoming overwhelmed.
A panel comprised of six Supreme Court Judges will review each case to determine if it should be accepted or rejected. Judges will also evaluate the merits of each claim to decide how much money a plaintiff should be awarded.
At present, the panel is reviewing more than 3,500 lawsuits. The panel is expected to issue its final decision before the end of this year.
