New York Asbestos Lawsuits
Asbestos fibers are deadly and can cause severe medical conditions, such as mesothelioma. A New York asbestos attorney is adept at handling lawsuits to seek financial compensation for those who have suffered from asbestos exposure and their families. These cases can be a bit complicated, so it's important to have a mesothelioma attorney to assist you.
New York has a long history of asbestos litigation, and many residents have been exposed to this hazardous material. In recent years there have been more lawsuits against former asbestos manufacturers than ever before. These cases result from the recognition of a link between asbestos and diseases like mesothelioma, lung cancer and asbestosis. The companies were aware of the dangers associated with this hazardous mineral, but failed to inform their employees and customers.
The New York City area is particularly prone to asbestos-related diseases due to its old structures and a myriad of construction sites. The Brooklyn Navy Yard was a notoriously toxic place that continues to impact on the community around it.
Mesothelioma can be caused by exposure to asbestos in direct contact and many workers were exposed in the workplace. However, some people are diagnosed with mesothelioma after experiencing an exposure secondarily to the harmful substances. This includes spouses who wear husband's clothes at work and come in contact with
asbestos legal dust on a regular basis.
The mesothelioma lawsuit can be costly for defendants. This is particularly true if they have been incorrectly identified as defendants. According to an investigation, more than 3,600 claims have been filed in New York courts since 2014 and the number is expected to increase even more. The asbestos law firms that specialize in asbestos often advertise on daytime TV and encourage victims to submit claims under the premise that they will receive significant settlements.
Defendants may be able to reduce some of the costs arising from these cases by arguing that their policy periods have expired or they are only responsible for a small percentage of the claim value. New York law does not provide a definitive rule on how to divide liability when the alleged risk is within and part outside of the insurer's policies.
Asbestos-related diseases
Exposure to asbestos can lead to a wide range of illnesses. The most severe condition is mesothelioma. Mesothelioma has led to the deaths of many people. Other asbestos-related illnesses include asbestosis and lung cancer. Pleural plaques and pleural effusion are also asbestos-related.
Mesothelioma is a rare, but fatal disease, is caused by asbestos fibers that are found in the lungs. They then cause irritation to the linings of the ribcage (the Pleura) as well as the chest cavity and abdominal cavity. The inhalation of these small fibers can cause scarring of the lungs, a condition known as asbestosis and sometimes the formation of thickened patches on the pleura called plaques of pleura or an enlargement of fibrosis in the pleura known as diffused fibrisis. Pleural plaques or diffuse fibrosis could reduce lung capacity, as determined by a breathing test. They can also cause pain and difficulty in breathing, however they are not the cause of cancer or mesothelioma.
The signs of asbestos-related illness typically do not manifest until decades after initial exposure. This is because it can take between 20 to 50 years for the inhalation of asbestos-containing fibers to damage the lungs. Workers who handled, cleaned and removed asbestos from the workplace and their children, spouses and others who were exposed to asbestos are at risk for developing mesothelioma.
Other asbestos-related illnesses, apart from mesothelioma, include laryngeal carcinoma and lung cancer and peritoneal, ovarian and peritoneal cancer. Ovarian cancer is the deadliest form of mesothelioma for women, but it is less common than mesothelioma general. It is often diagnosed later than other kinds of mesothelioma since it is a cancer that develops in the tissue of the reproductive organs, and the symptoms may be similar to symptoms of other diseases.
Many companies employed
asbestos legal in the 20th century, but they were aware that it was a risk. When they failed to remove it from their products, thousands of people were exposed. Many states have established special asbestos courts, where claims can be filed more efficiently. Judges have also developed special procedures to review and resolve such cases.
New York, a state with its own asbestos court (known as NYCAL), is one of the states. The number of cases filed in this court has grown steadily, as asbestos victims are becoming more and more likely to seek compensation from solvent asbestos defendants who went bankrupt. The New York Supreme Court created an additional judicial board that will supervise NYCAL to stop the justice system from becoming overwhelmed.
A panel of six Supreme Court Judges will review each case to determine if it is accepted or rejected. Judges will also consider the merits of each claim to determine how much a plaintiff should receive.
The panel is currently reviewing more than 3500 lawsuits. The panel is expected to issue its final ruling by the end of this year.
